These Terms and Conditions ("Terms") govern your access to and use of the HypeFrame Service. By creating an account, using the Service, or clicking "I agree," you agree to be bound by these Terms and conditions.

1. Definitions
- Account: the user account you create to access the Service.
- User / You: an individual or entity using the Service.
- User Content: any data, code, text, images, or other materials you upload to, submit to, or create with the Service.
- Subscription: a paid plan granting access to paid features.
- Documentation: published user guides, API docs, and help files for the Service.
10. Third-Party Services & Integrations
The Service may integrate with third-party platforms (APIs, payment processors, cloud providers). Those third parties are governed by their own terms and privacy policies. We are not responsible for third-party actions or outages.
11. Beta Features & SLAs
Beta or preview features are provided "as-is" and may be changed or removed. If we offer a Service Level Agreement (SLA) for uptime or credits, such SLA will be a separate agreement; absent that, no uptime guarantee is made.
12. Confidentiality
Each party will keep confidential information of the other party confidential and will not disclose it except to employees/contractors who need access, or as required by law. Confidential information excludes publicly available information and information independently developed or obtained.
13. Warranties & Disclaimers
We provide the Service on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
14. Limitation of Liability
To the maximum extent permitted by law, our liability for any claim arising out of or relating to these Terms or the Service is limited to direct damages up to the amount of fees you paid in the 12 months preceding the claim (or USD $100 if you paid nothing). We are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages, loss of profits, data, or business interruption.
15. Indemnification
You agree to indemnify, defend, and hold harmless HypeFrame and its affiliates, officers, and employees from any claim, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising from (a) your breach of these Terms, (b) your User Content, (c) your misuse of the Service, or (d) your violation of applicable laws.
16. Termination & Suspension
Either party ('User" & "Company") may terminate these Terms for cause by deactivating the account by the "User" or the by the "Company", if the other party materially breaches and fails to cure within 30 days of notice. We may suspend or terminate access immediately for violations, suspected fraud, security incidents, or legal requirements. After termination, your right to access the Service ends; we may delete or archive data per our data retention policy.
17. Export Controls & Sanctions
You shall comply with all export controls and economic sanctions laws. You will not access or use the Service in violation of such laws.
18. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. Disputes will be resolved in the courts located in Wyoming unless otherwise required by local law. For jurisdictions where mandatory consumer protections apply, those protections will be controlled.
19. Changes to Terms
We may modify these Terms by posting an updated version and indicating the effective date. If a change is material, we will provide notice (e.g., email). Continued use after the effective date constitutes acceptance.
2. Provision of Service
We provide a cloud-based Software-as-a-Service platform (AI-assisted code generation and related SaaS features). We may update, modify, or discontinue features at any time. We may provide free trials, beta features, or preview features; those may have different terms and may be revoked at any time.
20. Notices
Notices to you may be made via email or in-app messaging. Notices to us should be sent to legal@hypeframe.ai.
21. Entire Agreement; Severability
These Terms (and any referenced documents) constitute the entire agreement between you and HypeFrame. If a provision is unenforceable, it will be reformed to the minimum extent necessary and the remainder will remain in force.
22. Additional Terms
Certain features (APIs, team accounts, enterprise plans) may have additional terms. Those additional terms supplement these Terms.
3. Accounts, Eligibility & Registration
- You must be at least 13 years old (or the age of majority in your jurisdiction) to sign up.
- You are responsible for keeping your account credentials secure and for all activity under your account. Please notify us immediately of any unauthorized use.
- You must provide accurate information and keep it up-to-date.
4. Subscription, Fees, Billing & Refunds
- Paid features require subscription fees as described on our site. Fees may be billed monthly or annually and automatically renew unless cancelled per your account settings.
- All fees are non-refundable unless otherwise specified in writing. We may offer refunds at our discretion for exceptional cases.
- You are responsible for applicable taxes. Payment is processed through third-party processors; their terms also apply.
5. License Grant & Restrictions
- (a) copy, modify, or create derivative works of the Service;
- (b) reverse engineer, decompile, or attempt to extract source code;
- (c) resell, sublicense, or provide the Service to third parties except as expressly permitted;
- (d) remove or alter proprietary notices;
- (e) use the Service to build a competing product.
Subject to these Terms and your payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes. You may not:
- (a) copy, modify, or create derivative works of the Service;
- (b) reverse engineer, decompile, or attempt to extract source code;
- (c) resell, sublicense, or provide the Service to third parties except as expressly permitted;
- (d) remove or alter proprietary notices;
- (e) use the Service to build a competing product.
6. Ownership
We (or our licensors) retain all rights, title, and interest in and to the Service, platform, software, models, Documentation, and any Company-created content. You only retain ownership of your "User Content". By submitting "User Content" you grant us a worldwide, royalty-free license to host, use, reproduce, modify, and display the User Content as necessary to provide the Service, improve the Service, and comply with legal obligations.
7. User Content, AI Outputs, and Responsibility
You are solely responsible for the User Content you submit and for any outputs produced by the Service (including AI-generated code). You represent and warrant that you have all rights and consents necessary for the processing and use of such content. AI-generated outputs are provided "as-is." You must review, test, and validate any AI-generated code before deploying it. We are not responsible for defects, security vulnerabilities, or third-party claims arising from your use of AI outputs. You must not submit content that infringes rights, is unlawful, or violates these Terms. We may remove or disable access to content that violates these Terms.
8. Acceptable Use / Prohibited Conduct
- Violate laws or rights of others;
- Distribute malware, spyware, or facilitate cyberattacks;
- Engage in harassment, hate speech, or illegal content creation;
- Attempt to reverse engineer or circumvent security;
- Abuse or overload the Service (including automated scraping) or use the Service to send unsolicited messages.
You must not use the Service to:
- Violate laws or rights of others;
- Distribute malware, spyware, or facilitate cyberattacks;
- Engage in harassment, hate speech, or illegal content creation;
- Attempt to reverse engineer or circumvent security;
- Abuse or overload the Service (including automated scraping) or use the Service to send unsolicited messages.
We may suspend or terminate accounts that violate these rules.
9. Security & Data Protection
We implement commercially reasonable administrative, technical, and physical safeguards to protect data. However, no internet service is perfectly secure. You must maintain the security of your systems and credentials. We will notify you of security incidents affecting your User Data in accordance with applicable law.
